User Agreement

ARTICLE 1 — PARTIES

This User Agreement ("Agreement") is concluded electronically between:

OFFBEAT İSTANBUL TRAVEL TURİZM, a company incorporated under the laws of the Republic of Türkiye (hereinafter referred to as "OFFBEAT", "Company", "we", or "us"),

and the individual or entity registering on or using the Platform (hereinafter referred to as the "MEMBER", "User", or "you").

OFFBEAT and the MEMBER shall collectively be referred to as the "PARTIES".

ARTICLE 2 — PURPOSE AND SCOPE

This Agreement governs the terms and conditions under which the MEMBER accesses and uses the online platform owned and operated by OFFBEAT for booking passenger transportation services in Türkiye and internationally.

OFFBEAT acts as an intermediary platform connecting Members with licensed transportation providers.

ARTICLE 3 — DEFINITIONS

  • Platform: The website, mobile application, and related services operated by OFFBEAT.
  • Transportation Service: Passenger transport service provided by independent licensed drivers or transport companies.
  • Carrier: The third-party transport provider responsible for performing the transportation service.
  • Shared Ride: A transportation service where multiple passengers share the same vehicle on similar routes.
  • Booking: A reservation made by the MEMBER through the Platform.

ARTICLE 4 — MEMBERSHIP AND ELIGIBILITY

  • The MEMBER must be at least 18 years old and legally capable of entering into binding agreements.
  • The MEMBER agrees to provide accurate, complete, and up-to-date personal and travel information.
  • The MEMBER is responsible for maintaining the confidentiality of account credentials.
  • OFFBEAT reserves the right to suspend or terminate accounts in case of misuse or fraudulent activity.

ARTICLE 5 — ROLE OF OFFBEAT

  • OFFBEAT is not a transportation provider.
  • OFFBEAT acts solely as an intermediary between the MEMBER and the Carrier.
  • The transportation contract is formed between the MEMBER and the Carrier.
  • OFFBEAT may coordinate bookings, payments, and customer support.

ARTICLE 6 — BOOKING AND PAYMENT

  • All bookings are subject to availability and confirmation.
  • A booking becomes valid only after full payment is received.
  • Payments are processed securely via third-party payment providers.
  • Prices include applicable taxes unless otherwise stated.

ARTICLE 7 — CANCELLATION AND REFUND POLICY

7.1 Standard Private Transfers

  • Free cancellation or modification up to 24 hours before scheduled pickup time
  • Late cancellations are non-refundable

7.2 Shared Rides

  • Cancellation or modification not permitted within 6 hours before service
  • No refund for late cancellation or no-show

7.3 Refund Processing

Approved refunds will be issued to the original payment method within 5–14 business days, depending on banking procedures.

ARTICLE 8 — NO-SHOW POLICY

A booking is considered a no-show if:

  • The MEMBER is not present at the agreed pickup location
  • The MEMBER cannot be contacted using provided details
  • The waiting time has expired
  • Incorrect pickup information was provided

No refund will be issued in such cases.

ARTICLE 9 — FLIGHT DELAYS AND WAITING TIME

  • For airport pickups, the Carrier may monitor flight information when provided.
  • Drivers will wait up to 60 minutes after actual landing time unless otherwise specified.
  • Additional waiting time may be charged.
  • If the passenger cannot be contacted, the service will be considered a no-show.

ARTICLE 10 — PASSENGER OBLIGATIONS

The MEMBER agrees to:

  • Arrive on time at the pickup location
  • Provide accurate contact details
  • Keep communication devices operational
  • Follow driver instructions
  • Comply with local laws

OFFBEAT or the Carrier may refuse service to passengers whose behavior threatens safety or public order.

ARTICLE 11 — BAGGAGE POLICY

  • The MEMBER must declare luggage requirements during booking.
  • Excess or oversized baggage may result in additional charges or service refusal.
  • The Carrier is not responsible for damage to fragile or valuable items unless required by law.

ARTICLE 12 — CHILD SEATS AND SPECIAL REQUESTS

Child seats and other special equipment:

  • Must be requested in advance
  • May incur additional fees
  • Are subject to availability
  • Cannot be guaranteed in all locations

ARTICLE 13 — VEHICLE CATEGORY

Vehicle images are illustrative only. OFFBEAT and the Carrier reserve the right to provide an equivalent or higher category vehicle if necessary.

ARTICLE 14 — LIABILITY LIMITATION

OFFBEAT shall not be liable for:

  • Acts or omissions of the Carrier
  • Traffic delays or route changes
  • Loss of personal belongings
  • Indirect or consequential damages

To the maximum extent permitted by law, OFFBEAT's total liability shall not exceed the amount paid for the booking.

The Carrier is responsible for the safe execution of transportation services.

ARTICLE 15 — PERSONAL DATA PROTECTION (GDPR / KVKK)

Personal data is processed in accordance with applicable data protection laws, including:

  • EU General Data Protection Regulation (GDPR)
  • Turkish Personal Data Protection Law No. 6698 (KVKK)

Data may be processed for:

  • Booking fulfillment
  • Legal compliance
  • Communication
  • Customer support

Marketing communications require explicit consent and can be withdrawn at any time.

ARTICLE 16 — FORCE MAJEURE

OFFBEAT shall not be liable for failure or delay due to events beyond reasonable control, including but not limited to:

  • Natural disasters
  • Severe weather
  • War, terrorism, civil unrest
  • Government actions
  • Strikes
  • Pandemics
  • Traffic accidents or road closures

ARTICLE 17 — INSURANCE

Carriers are required to hold valid insurance as mandated by applicable laws. OFFBEAT does not provide additional insurance unless explicitly stated.

ARTICLE 18 — COMPLAINTS

Complaints must be submitted in writing within 7 days after the service date. Claims submitted after this period may not be considered.

ARTICLE 19 — ELECTRONIC AGREEMENT

Acceptance of this Agreement electronically constitutes a legally binding contract equivalent to a written signature.

ARTICLE 20 — GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by the laws of the Republic of Türkiye.

Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the Istanbul (Central) Courts and Enforcement Offices, unless mandatory consumer protection laws provide otherwise.
